NextGen Community Terms of Use

Note! You are concluding a Legally Binding Agreement.

This NextGen Community Use Agreement (the "Agreement") provides important information about your use of the NextGen Community site (the "Site"). You should read it, understand it, and consider printing a reference copy as you use the Site.

IMPORTANT: IF YOU CHOOSE TO ACCEPT THIS AGREEMENT, YOU MUST ACCEPT IT AS PRESENTED TO YOU, WITHOUT CHANGES. NEXTGEN WILL ACCEPT NO ADDITIONS OR DELETIONS. At any time NextGen Healthcare may change, add, or remove any part of this Agreement or any part of the services and features provided at the Site. If it does so, NextGen Healthcare will update the Agreement and may also post such changes elsewhere on the Site.

IF ANY FUTURE CHANGE IS UNACCEPTABLE TO YOU, YOU SHOULD DISCONTINUE USING THE SITE. YOUR CONTINUED USE OF THE SITE WILL ALWAYS INDICATE YOUR ACCEPTANCE OF THIS AGREEMENT AND ANY CHANGES TO IT.

  1. General
    1. As long as you comply with the Agreement, NextGen grants you a personal, nonexclusive, non-transferable, limited privilege to enter and use the Site.
    2. Comply with laws and the Agreement: You must comply with all applicable laws, the Agreement, as may be amended, and the following terms, which are incorporated into this Agreement.
    3. In addition to the terms and conditions in the Agreement, all use of the Site is governed by the www.nextgen.com Terms of Use (www.nextgen.com/about/legal_notice.html).
    4. In the event of any conflict between this Agreement and www.nextgen.com Terms of Use, the terms of this Agreement will govern.
    5. The views expressed on the site are not endorsed by NextGen Healthcare.
    6. NextGen Healthcare does not prescreen information submitted by users of the Site (“Submissions”). NextGen Healthcare retains the right, but not the responsibility, to edit or remove any Submission, including those deemed by NextGen Healthcare to violate the Agreement. NextGen Healthcare will make good faith efforts to investigate allegations that Submissions violate the Agreement but (a) makes no warranty to you that it will edit, remove, or continue to permit the display of any specific submission, whether or not subject to such allegations, and (b) will have no liability whatsoever for editing, removing, or continuing to permit the display of any Submission whatsoever.
    7. NextGen Healthcare involvement: NextGen Healthcare does not formally provide technical support on the site. However, any information that is provided by NextGen Healthcare or NextGen Healthcare employees is offered on an “as is” basis without warranties of any kind.
    8. To submit information to the site, each user must have a unique user name and password combination, known as an “NGProfile” ID. Please review NextGen Healthcare’s Privacy Policy (http://www.nextgen.com/about/privacy_policy.html), which describes how NextGen collects, uses and protects your personal information. NextGen Healthcare cannot and will not be responsible for any problems or liability that may arise if you do not provide accurate, truthful and complete information.
    9. Keep your password secure. Keep your password confidential, do not use other Users’ accounts and do not let others use your account; you are responsible for anything that happens through your account — until you notify us of a breach, close down your account or prove that your account security was compromised due to a fault of our systems. You are prohibited from selling, trading or otherwise transferring your NextGen Healthcare profile or any information therein to another party or charging anyone for access to any portion of the NextGen Community, or any information therein.
    10. Don’t reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying intellectual property used to provide NextGen Healthcare, or any part thereof.
    11. Don’t remove any copyright, trademark or other proprietary rights notices contained in or on Community.NextGen.com, including those of both NextGen Healthcare or any of its licensors.
    12. NextGen Healthcare retains the right, but not the responsibility, to edit or remove any profile imagine or photo they feel does not deem fit for the community.
    13. Don’t use automated scripts to collect information from or otherwise interact with the service or the site.
    14. Don’t register for more than one user account, register for a user account on behalf of an individual other than yourself, or register for a user account on behalf of any group or entity. Don’t impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity.
    15. Don’t upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  2. Forum Posts
    1. Be polite. Everyone should feel comfortable reading Submissions and participating in discussions. NextGen Healthcare will not tolerate flames or other inappropriate statements, material, or links. Most often, a "flame" is simply a statement that is taunting and thus arbitrarily inflammatory. However, this also includes those which are libelous, defamatory, indecent, harmful, harassing, intimidating, threatening, hateful, objectionable, discriminatory, abusive, vulgar, obscene, pornographic, sexually explicit, or offensive in a sexual, racial, cultural, or ethnic context.
    2. Advertising of non NextGen Healthcare related information is not permitted without NextGen Healthcare’s consent and will be deleted should an advertisement is submitted within the forum.
    3. No inappropriate user names (“Aliases”) or impersonations. Inappropriate or offensive user names or aliases will be removed and persons attempting to impersonate another user will be removed. User names may not contain website, email addresses or other contact information.
    4. Keep within the Law
      1. No material may be submitted that is intended to promote or commit an illegal act.
      2. Do not post defamatory material.
    5. License to Use Submission. By sending a Submission to the Site you agree to grant NextGen Healthcare a perpetual, royalty-free, non-exclusive worldwide right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to the Submission. If you do not want to grant to NextGen Healthcare the rights set out above, do not send your submission to the site.
  3. Minors
    1. You must be at least 18 years old to post to the Site.
  4. Interference with the Site.
    1. You agree to not interfere with or disrupt the site.
  5. Breach of the Site.
    1. If you fail to abide by these terms NextGen Healthcare may remove your submission. NextGen Healthcare may also send an e-mail that informs you that your submission has been deleted or edited. Repeated inappropriate submissions may result in your relevant account or accounts being placed into temporary or permanent suspension of your ability to participate in any or all of the areas on the site.
    2. If you post or send offensive or inappropriate content anywhere on or to the site or otherwise engage in any disruptive behavior which NextGen Healthcare considers to be serious and/or repeated, NextGen Healthcare may use all available information about you to stop any further infringements. This may include informing relevant third parties such as your employer, school, Internet service provider, or law enforcement authorities of the infringement.
    3. NextGen Healthcare reserves the right to delete any submission, or take action against any account, at any time, for any reason.
